General Rental and Usage Conditions
LEGAL NATURE OF THE CONTRACT
This document serves as the general terms of sale and rental agreement, outlining the rules related to occupancy. It is provided to the renter on the website and in the booking confirmation email. All rental and contract terms are considered accepted upon booking confirmation. This rental contract, available for nightly, weekend, or weekly stays, is exclusively for the rental of Les Gites du Vieux Tilleul’s tourist accommodations. Les Gites du Vieux Tilleul cannot be held liable if the contracts are used by third parties or for purposes other than intended.
CONTRACT
The reservation is confirmed once the renter has paid the full booking amount, which constitutes acceptance of this contract. The electronic confirmation serves as both a signature and acceptance. The contract details, including conditions and check-in/check-out times, will align with the booking confirmation, and any changes are subject to prior acceptance by the owner and may incur additional charges.
DURATION OF STAY
The renter signing this contract for a fixed period cannot claim any rights under French residential lease law, specifically regarding the right to stay beyond the originally agreed-upon rental period.
CHECK-IN AND CHECK-OUT
Check-in and check-out times are provided in the booking confirmation emails.
LIABILITY
The owner is not liable for any damage or theft of personal belongings in the accommodation or outdoor spaces. The owner is not responsible for force majeure events or disturbances affecting the stay. Minors under 18 years old are solely and fully under the responsibility of their parents throughout the stay.
NUMBER OF OCCUPANTS
The number of guests cannot exceed the accommodation’s capacity (2 persons). The actual number of occupants must match the number specified in the contract. Failure to comply will result in rental cancellation, and the renter will bear the cost of the stay. The owner must be informed of any visitors to the property.
PETS
Pets are not permitted for hygiene and allergy reasons. If this rule is violated, the owner or their representative will refuse the stay, and no refund will be provided.
USE OF PREMISES
The renter agrees to personally occupy the premises as specified in the contract and to maintain them. The renter must respect neighborhood tranquility.
The property cannot be used for purposes other than residence by the renter (e.g., no parties, commercial or professional activities, or activities contrary to French law and public order).
The renter agrees to read and adhere to the instructions and manuals available in the accommodation.
– Non-smoking policy: The premises are strictly non-smoking. A €500 cleaning fee applies for any evidence of smoking. The renter assumes responsibility in case of accidents or fires.
– Internet usage: Access to unauthorized websites under French law is prohibited. Internet use must remain for normal, family purposes.
– Illegal activities: All illegal activities are strictly prohibited. The owner cannot be held liable for any illegal or immoral actions of the clients, whether inside or outside the rented property. Any breach of these rules may result in immediate termination of the rental contract, with no notice or refund.
HYGIENE RULES
For properties with a sauna and/or spa, please strictly follow the usage and hygiene guidelines. Food, drinks, and alcohol are not allowed in these areas. Specific measures are in place for everyone’s safety, achievable only with everyone’s cooperation. People with heart conditions, high blood pressure, or pregnant women should not use the sauna. The owner cannot be held liable for any health issues, and no refunds or compensation will be provided in such cases.
CLEANING
Routine cleaning is the responsibility of the owner. However, in cases of excessive or abnormal dirt, additional cleaning fees (€20/hour) may be charged to the renter.
CANCELLATION BY THE RENTER
The renter does not have a right of withdrawal under Article L. 221-5 of the French Consumer Code. Payment is total and final upon booking.
However, if the renter provides legitimate and serious reasons, they may request a rescheduling of their reservation if the request is made at least 30 days before the stay.
The renter may also request a refund under the following conditions:
- For cancellations over 45 days before the scheduled arrival, 100% of the booking amount will be refunded, less booking fees.
- For cancellations over 30 days before the scheduled arrival, 50% of the booking amount will be refunded, less booking fees.
- For cancellations less than 30 days before arrival, no refund is possible.
- If the stay is shortened, the full rental price remains due to the owner, except for the security deposit.
The owner is not liable for non-performance due to force majeure, third-party actions, or renter actions. Cancellation insurance is recommended.
PRICING
Rates and minimum stay durations are available on the website. Prices are subject to change at any time. Stays are billed based on the rates at the time of booking unless a specific promotional offer applies.
Prices include all taxes and are expressed in Euros. Payment is due in Euros.
The renter affirms that they are fully authorized to use the payment method provided and that it has sufficient funds to cover all related costs.
According to Article L133-8 of the French Monetary and Financial Code, the renter cannot revoke a payment once received by the payee. Payment in full is required upon booking through the Les Gites du Vieux Tilleul website.
TOURIST TAX
Set at €1.76 per night per occupant over 18. This rate is set annually by Guingamp-Paimpol Agglomeration and is fully remitted to them.
INSURANCE
The owner declines all liability for accidents or theft. The renter is responsible for any damages to the premises, furnishings, and building, as well as the loss of any equipment. The renter must have civil liability insurance covering vacation rental risks. Lack of insurance in case of damage may result in compensation claims. This insurance may be requested by the owner in case of disputes or damages.
UTILITY CHARGES
Water and electricity are included in the rental for “normal” use. Excessive or unjustified use may be charged to the renter.
PHOTOS
Photos on the website are not contractually binding.
COMPLAINTS AND DISPUTES
Any complaint during the stay must be reported immediately to the owner or their representative for prompt resolution. The renter cannot claim compensation for urgent repairs conducted during the stay.
For complaints about the property condition or inventory, these must be made within 2 hours of arrival. Both parties should prioritize an amicable resolution. All claims will be handled by the competent court where the rental is located.
